Guardianship Legal Services

Are you looking to become the legal guardian of a child in your life? Are you trying to ensure that your legal custody rights are not taken away and given to a legal guardian? At HLS we are able to assist you with all of your guardianship needs. Guardianship cases are filed in Probate Court, and not Family Court, which means you need a knowledgeable attorney who knows the system and can advocate on your behalf.

Frequently Asked Questions

What is guardianship of the person mean?

A guardian of the person may be appointed when a child’s parents/current legal guardians are unable to care for the child’s welfare. A guardian of the person will be awarded full physical and legal custody and is responsible for providing all of the child’s life essentials.

What is guardianship of the estate?

The money and assets of a child are considered the child’s estate. A court will appoint a guardian of the estate to fully manage this estate by controlling the funds, collect and make inventory of assets, make investments, and more.

Is Guardianship the same as Adoption?

No, guardianship is not the same as adoption. A guardianship gives custody of a child to the guardian whereas adoption completely severs ties between child and parent. When a guardianship is awarded, parents must continue to support their children financially and in turn may be awarded visitation with the child while under the guardians care.
